1. Scope of application
These general terms and conditions of use shall apply to any visit to the Maison Hayoit website.
By visiting or using the online store, Internet users shall acknowledge that they have read these terms of use and expressly accept the rights and obligations that arise out of them.  
The provisions of these terms and conditions of use may exceptionally be waived by written agreement. Such derogations may consist of the amendment, addition or deletion of the clauses to which they pertain and shall have no effect on the application of the other provisions of the terms and conditions of use.
Maison Hayoit reserves the right to amend these general terms and conditions of use at any time, without prior notice, but undertakes that the terms and conditions of use applicable to the Internet user shall be those in force at the time of use of the website.

2. Access and browsing
Maison Hayoit shall take all such measures as reasonable and necessary to ensure the proper functioning, security and accessibility of the website.
Maison Hayoit cannot, however, guarantee absolute operability and shall consequently be bound by an obligation of means.
Any use of the website shall be at the risk of the Internet user. Maison Hayoit shall consequently not be held liable for any direct or indirect damage that may result from possible malfunctions, interruptions, or defects in the Internet user’s computer system, harmful elements present on the website or a cyberattack. The Internet user shall refrain from claiming any compensation.
Maison Hayoit reserves the right to restrict access to the website or to interrupt its operation at any time, without prior notice.

3. Content
Maison Hayoit shall determine the content of the website and take all measures to ensure that it is complete, accurate and up to date but shall not offer any absolute guarantee as to the quality of the information thereon. Maison Hayoit cannot therefore be held liable for any damage, direct or indirect, that the Internet user would suffer from the information posted on the website.
Maison Hayoit reserves the right to update, complete or remove the website and its content at any time, without incurring any liability.

4. Services reserved from Internet users with an account
a) Creation of an account
A customer account must be created in order to access the online store.
The creation of the account and access to the online services of the website shall be reserved exclusively for legally capable natural persons.
Only one registration per natural person shall be authorized.
Registration and access to the online services by a legal entity shall be carried out through a natural person.
When creating their account, Internet users shall undertake to provide accurate, sincere and up-to-date information about their person or registered office in the case of a legal entity. They shall moreover have to proceed to a regular verification of the data concerning them in order to keep them accurate.
Internet users must provide a valid e-mail address without fail, where Maison Hayoit will send a confirmation of their registration.
The e-mail address may not be used several times.
Internet users shall be issued a username to enable them to access their personal space and the online store, in addition to the entry of their password.
The username shall be definitive but the password can be changed online by the Internet users in their personal space.
The password shall be personal and confidential.
Maison Hayoit reserves in any event the right to refuse an account if the Internet user does not comply with these terms and conditions or if the e-mail address is not valid.
b) Unsubscribing
A duly registered Internet user may request to unsubscribe at any time.
Such deregistration shall take effect once the Internet user has completed the form via the contact page on the website and Maison Hayoit has approved said request.

5. Links to other websites
The website may include links to other websites or other Internet sources.
Such links shall not automatically entail that there is a relationship between Maison Hayoit and the external website(s) or even that that there is an implicit approval of the content of this (these) external website(s).
Insofar as Maison Hayoit cannot control said site(s) and external source(s), it cannot be held liable for the availability thereof, nor for the content, advertising, products, services or any other information or data available on or from said external sites or sources.
Maison Hayoit shall moreover not be held liable for any damage or loss(s), proven or alleged, ensuing from or in relation with the use or the fact of having trusted the content, goods or services available on this site(s) or external source(s).
Any creation of links to Maison Hayoit, any framing of the website, and more generally any use of a constituent element of the website, shall be subject to the prior, explicit consent of Maison Hayoit which may be revoked at any time at the latter’s sole discretion.
Maison Hayoit reserves the right to request that any link to the site not or no longer authorized be removed, and to claim damages for the loss suffered as a result.

6. Intellectual property
a) Website
The structuring of the website as well as its constituent elements and content such as texts (policies,...), graphics, images, photographs, graphic elements, sounds, videos, databases, newsletters, computer applications, etc. or any other element accessible via the website shall be the property of Maison Hayoit and protected as such by the intellectual property legislation in force.
Any representation, reproduction, adaptation or partial or total use of the contents, trademarks and services offered by the website, through any process whatsoever, without the prior, express and written consent of Maison Hayoit, shall be strictly forbidden. The reproduction of all or part of the contents of the website shall be authorized only for the exclusive purpose of information for personal and private use.
Maison Hayoit shall not grant any licence, nor any right other than that of consulting the website.
b) Trademark
Maison Hayoit is the owner of the trademark and its logo. Internet users shall consequently be prohibited from making any use thereof whatsoever without its express consent.
Maison Hayoit thus reserves the right to claim damages in the event of piracy or infringement of its intellectual property rights.

7. Personal data protection
The personal data provided by Internet users when they visit the website or create their account are collected and processed by Maison Hayoit exclusively for internal purposes.
Maison Hayoit assures Internet users that it attaches the utmost importance to the protection of their privacy and personal data, and that it is always committed to communicating clearly and transparently on this issue.
Maison Hayoit undertakes to comply with the applicable legislation on this matter, namely the Protection of Privacy with Regard to the Processing of Personal Data Act of 8 December 1992 and Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
The Internet user’s personal data shall be processed in accordance with the Privacy Policy posted on the website.

8. Applicable law and competent court
These general terms and conditions of use shall be governed by Belgian law.
Any complaint by the customer concerning these general terms and conditions of sale shall be lodged with Maison Hayoit by email at info@hayoit.com.
In the event of dispute where no prior amicable agreement is reached, the case shall be referred to the courts of the judicial district of the registered office of Maison Hayoit.

Any translation from the French shall be provided as and where necessary for the sake of convenience and shall have no legal value.

9. General provisions
Maison Hayoit reserves the right to amend, extend, remove, limit or discontinue its site and associated services at any time without prior notice and without being held liable as a result.
If these general terms and conditions are violated by the Internet user, Maison Hayoit reserves the right to take appropriate sanction and reparation measures.
Maison Hayoit reserves in particular the right to refuse the Internet user’s account or access to its services temporarily or permanently
These measures may be taken without indication of reason and without notice. They cannot entail the liability of Maison Hayoit or give rise to any form of compensation.
The illegality or total or partial nullity of any provision of these general terms and conditions of use shall have no impact on the validity and application of the remaining provisions. In such an eventuality, Maison Hayoit reserves the right to replace the illegal or void provision by a valid provision of similar scope.
